s 6(2)A Code-covered person must not, without a reasonable justification, represent (s 6(2)(a)) or charge (s 6(2)(b)) a price for supplying goods to a participant that is higher than the price it represents or charges for the same, or substantially the same, goods to a person who is not a participant. Added from 19 December 2023. The prohibition covers goods, not services; a provider that relies on a reasonable justification for a difference should be able to show what it was.
