Requirement, our statement of the clause

Because poor performance endangers patients, where there is a risk good practice means the practitioner: (a) recognises and reduces fatigue risk, including compliance with the work health and safety laws of the state or territory; (b) follows 9.1 if they know or suspect a health condition could affect their judgement or performance; (c) acts to protect patients from risks arising from a colleague's conduct, practice or illness (9.2); (d) complies with statutory reporting duties, including mandatory notifications under the National Law; (e) helps a colleague get help when worried about the colleague's performance or fitness to practise; and (f) seeks advice from an experienced colleague, employer, practitioner health service, professional indemnity insurer, the Boards or Ahpra, or a professional body when unsure.

Evidence that typically shows this
  • Roster records showing hours and rest breaks within fatigue limits
  • Record of advice sought when concerned about a colleague's performance
  • Mandatory notification lodged where the statutory threshold was met
Common gap to check
  • Excessive consecutive shifts with no fatigue assessment
  • Concerns about a colleague discussed but not acted on
