Who it applies to

Registered NDIS providers audited by certification: registered for early childhood supports, specialist behaviour support, implementing behaviour support plans or regulated restrictive practices, or specialised support coordination. An individual or partnership whose only certification requirement is early childhood supports meets only Core clause 7 (freedom from abuse) and Module 3 (Rules s 20(4) and (5)).

The NDIS Commission's review of the Practice Standards (a proposed quality framework and changes to the standards and how they are assessed) is still being considered; nothing from it is in force.

Requirement, our statement of the clause

When the participant wishes, the provider identifies the participant's culture, diversity, values and beliefs and responds to them sensitively in how supports are designed and delivered.

Evidence that typically shows this
  • Intake and assessment forms capturing cultural, religious, gender and other identity preferences at the participant's direction
  • Support plans showing how those preferences shape delivery (worker gender, food, observances)
  • Cultural awareness or diversity training records for workers
Common gap to check
  • Cultural and identity questions skipped or completed by staff without asking the participant
  • Preferences recorded at intake but not reflected in rosters or plans

Requirement, our statement of the clause

Each participant is supported to practise their culture, values and beliefs while receiving supports, for example attending ceremonies, worship, community events or following dietary and dress practices.

  • Rosters or progress notes showing support to attend cultural or religious activities
  • Menu and meal records reflecting cultural or religious dietary practice
  • Participant feedback or survey results on respect for their beliefs
Common gap to check
  • Practices limited because of service routines rather than participant choice
  • No record of how a known observance is supported
