Who it applies to

Registered NDIS providers audited by certification: registered for early childhood supports, specialist behaviour support, implementing behaviour support plans or regulated restrictive practices, or specialised support coordination. An individual or partnership whose only certification requirement is early childhood supports meets only Core clause 7 (freedom from abuse) and Module 3 (Rules s 20(4) and (5)).

The NDIS Commission's review of the Practice Standards (a proposed quality framework and changes to the standards and how they are assessed) is still being considered; nothing from it is in force.

Core 3.1Person-centred supports: participant rights built into everyday practicesource
Requirement, our statement of the clause

Workers and managers understand the legal and human rights of each participant, and those rights visibly shape how supports are planned and delivered day to day rather than sitting only in a policy.

Evidence that typically shows this
  • Participant rights policy referencing the UN Convention on the Rights of Persons with Disabilities and the NDIS Code of Conduct
  • Worker induction and refresher records covering participant rights
  • Sample of support plans or progress notes showing rights considered in decisions
  • Interview notes or observation records where workers explain participant rights
Common gap to check
  • Rights policy exists but workers cannot describe how it changes their practice
  • Restrictions on participants imposed for convenience with no rights consideration recorded
Core 3.2Person-centred supports: communication in the participant's language and modesource
Requirement, our statement of the clause

Communication with each participant about their supports matches their needs and uses the language, communication mode and terms the participant is most likely to understand, including interpreters, Easy Read, AAC or other aids where needed.

Evidence that typically shows this
  • Communication needs and preferences recorded on each participant file
  • Easy Read or translated versions of key documents given to participants
  • Interpreter booking records and AAC or communication aid use in progress notes
  • Communication policy describing how needs are identified and met

  • Standard English documents given to participants with recorded communication needs
  • Family members used as interpreters without the participant's agreement
Core 3.3Person-centred supports: links with support network and chosen communitysource

The provider supports each participant to stay connected with their support network and the community they choose, in the way and to the extent the participant directs.

Evidence that typically shows this
  • Support plans recording the people and community activities the participant wants to keep
  • Progress notes or rosters showing support for community access and contact with family and friends
  • Records of the participant's directions about who may be involved in their supports
Common gap to check
  • Community access dropped when staffing is short with no discussion with the participant
  • Family involved in decisions without the participant's direction
