Every NDIS provider and its workers, registered or not, every profession.
Every Code-covered person acts with integrity, honesty and transparency: recommending and providing only supports that suit the participant's needs, declaring and avoiding real or perceived conflicts of interest, and not engaging in or promoting sharp practices such as pressure selling, misleading claims about funding, gifts or incentives to win business, or charging for supports not delivered. The guidance applies the element to the advertising and sale of an NDIS provider business.
- Conflict of interest register covering key personnel, related entities and referral arrangements
- Service agreements and invoices that match support delivery records
- Marketing and social media content review record showing no misleading claims about NDIS funding
- Gifts and benefits register
- Support coordinators steering participants to a related provider without disclosure
- Claims for supports that shift notes do not show were delivered
- Offers of gifts, vouchers or free goods to sign up participants (to be prohibited outright by s 73VA from 20 November 2026)
