Every NDIS provider and its workers, registered or not, every profession.
Every Code-covered person takes all reasonable steps to prevent and respond to sexual misconduct, which the guidance reads broadly (any act, gesture or comment of a sexual nature directed at or made in the presence of a person with disability, including grooming). Providers set clear boundaries for worker behaviour, screen and supervise, and operate effective processes for receiving, responding to and reporting allegations.
- Professional boundaries policy defining sexual misconduct and grooming, signed by each worker
- Allegation response procedure with reporting to police and the NDIS Commission
- Records of each allegation, immediate safety actions taken and investigation outcome
- Supervision arrangements for one-to-one supports in private settings
- Boundary breaches (personal messaging, gifts, meeting participants outside work) not treated as warning signs
- Allegations investigated by the accused worker's line manager alone
- Participants not told how to report sexual misconduct safely
