Requirement, our statement of the clause

Every Code-covered person takes all reasonable steps to prevent, and to respond to, all forms of violence against, and exploitation, neglect and abuse of, people with disability. For providers this includes a stated commitment to eliminating such harm, identifying and responding to incidents and reporting them to the NDIS Commission (registered providers under the reportable incident rules) and to police or other authorities as appropriate, and reducing and eliminating restrictive practices.

  • Safeguarding policy covering recognition, response and reporting of abuse, neglect, violence and exploitation
  • Reportable incident notifications to the NDIS Commission with timestamps, and police report references where relevant
  • Training records on recognising abuse and neglect for every worker
  • Restrictive practice register and behaviour support plans where restrictive practices are used
Common gap to check
  • Financial exploitation by workers (borrowing money, using participant cards) not recognised as abuse
  • Incidents handled internally without notifying the Commission or police
  • Unauthorised restrictive practices such as locked doors treated as routine
