NDIS (Practice Standards - Worker Screening) Rules 2018, Compilation No. 4 (F2021C00788), in force 31 July 2021
6 October 2026, Federal Register: latest version on 6 October 2026
Registered NDIS providers that have workers in risk assessed roles, and individual registered providers for their own clearance.
A person without a clearance may fill a risk assessed role only under an exception: (a) the person is in the process of obtaining a clearance, is appropriately supervised by a cleared person, the provider is implementing its s 12 risk management plan, and the law of the jurisdiction allows work while an application is pending; (b) the provider is complying with the Part 4 transitional arrangements and the person has no interim bar, exclusion, suspension or cancelled clearance; or (c) the person is a secondary school student on formal work experience directly supervised by a cleared worker (s 14(1)); individual providers have the equivalent exceptions (s 14(2)). Under s 14A the pending-application exception does not apply where the jurisdiction's law forbids working while an application is undecided and the person has no acceptable check for that jurisdiction.
- Exception register for each person working without a clearance: exception relied on, start and end dates, supervising cleared worker
- Jurisdiction check recording whether the relevant State or Territory law permits work while an application is pending
- Work experience placement agreement with the school and the supervisor's clearance
- Pending applicants rostered in a jurisdiction whose law applies no card, no start (Queensland, for example)
- Supervision nominal only (supervisor on another site)
- Exception relied on after the application was withdrawn, closed or refused
