Requirement, our statement of the clause

The system must require that people are given procedural fairness when the provider deals with an incident, including workers and others whose conduct is examined, having regard to any guidelines the Commissioner makes by notifiable instrument.

  • Procedure step giving a worker notice of allegations and a chance to respond before findings
  • Investigation file showing the response obtained and considered
  • Conflict of interest check for the investigator
